Lula ficará com título de cidadão catarinense, decide justiça
A Justiça de Santa Catarina negou uma ação movida por um empresário de Brusque (SC), que pedia para suspender o título de cidadão catarinense concedido em lei ao ex-presidente Lula pela Alesc (Assembleia Legislativa de Santa Catarina), em 2008. O processo corria desde 2018.
O empresário Newton Crespi alegou na ação que a lei teve desvio de finalidade, vício de forma, inexistência de motivos, e que teria como objetivo favorecer o ex-presidente na campanha de 2018 (que ele não disputou). A entrega simbólica da honraria ocorreu só em março daquele ano, uma década após a aprovação do título pelo Legislativo.
O pedido de anulação foi negado em primeira e segunda instância, pela 5ª Câmara de Direito Público do Tribunal de Justiça de Santa Catarina (TJSC). O entendimento unânime do TJSC é que esse tipo de homenagem é um ato político legislativo, sobre o qual não cabe interferência do Judiciário.
A hipótese de repercussão eleitoral foi afastada pelos desembargadores, por entenderem que os deputados que aprovaram a lei, em 2008, não tinham como adivinhar se Lula seria ou não candidato ou não dez anos depois. A ação transitou em julgado e foi arquivada.
