STF começa julgamento sobre marco temporal de terras indígenas
O Supremo Tribunal Federal (STF) iniciou, pouco antes das 15h, o julgamento sobre o marco temporal para demarcação de terras indígenas.
A sessão está sendo acompanhada no plenário da Corte por cerca de 50 lideranças indígenas. De lado de fora, policiais do grupamento de choque da Polícia Militar do Distrito Federal fazem a segurança do edifício-sede da Corte. Até o momento, não foram registrados incidentes.
No julgamento, os ministros discutem o chamado marco temporal. Pela tese, defendida por proprietários de terras, os indígenas somente teriam direito às terras que estavam em sua posse no dia 5 de outubro de 1988, data da promulgação da Constituição Federal, ou que estavam em disputa judicial na época.
O julgamento foi retomado com o voto do ministro Alexandre de Moraes, que pediu vista do processo em setembro de 2021, suspendendo a análise do caso. O placar do julgamento está empatado em 1 a 1. Antes da interrupção, o ministro Edson Fachin votou contra a tese, e Nunes Marques se manifestou a favor.
O processo que motivou a discussão trata da disputa pela posse da Terra Indígena (TI) Ibirama, em Santa Catarina. A área é habitada pelos povos Xokleng, Kaingang e Guarani, e a posse de parte da TI é questionada pela procuradoria do estado.
